Microsoft hits Motorola, Google with EU complaint
BRUSSELS (AP) ? Microsoft on Wednesday lodged a formal complaint with the European Union's competition regulator against Motorola Mobility and its soon-to-be owner Google, saying Motorola's aggressive enforcement of patent rights against rivals breaks competition rules.
The complaint follows a similar step by Apple against Motorola last week.
Motorola is in the process of being taken over by Google for $12.5 billion, the biggest acquisition in the Californian company's history. Microsoft fears that Google will continue Motorola's tight hold on key patents.
Apple Inc. and Microsoft Corp. have been hit by legal cases in Europe and the United States, with Motorola claiming that the companies' products are using key patents it owns without permission.
Apple and Microsoft, meanwhile, argue that Motorola is overcharging for the use of these patents, which cover technologies necessary to connect wirelessly to the Internet or stream video online.
"We have taken this step because Motorola is attempting to block sales of Windows PCs, our Xbox game console and other products," Dave Heiner, Microsoft's deputy general counsel, wrote in a blog post.
"Motorola is on a path to use standard essential patents to kill video on the Web, and Google as its new owner doesn't seem to be willing to change course," Heiner added.
A spokesman for Google Inc. declined to comment on the complaint against Motorola. He couldn't immediately be reached after Microsoft announced its complaint also targeted Google directly.
A spokeswoman for Motorola didn't immediately respond to an emailed request for comment.
The complaints are the latest development in increasingly acrimonious disputes between global technology giants over patents on standardized technologies.
Industrywide standards play an important role not only in the technology sector. They allow products from different companies to function seamlessly together ? different mobile phones or tablet computers connecting to the Internet and each other via 3-G or Wi-Fi networks, for example. Under EU competition rules, holders of patents necessary for industry standards are required to let other companies use them for a fair price.
But regulators and companies complain that holders of standard-essential patents have tried to gain an edge in the market by suing rivals over the use of their patented technologies.
When the European Commission, the EU's competition watchdog, cleared Google's takeover of Motorola earlier this month, it indicated concern over Motorola's aggressive patent enforcement. The Justice Department in its clearance of the merger made similar comments.
Separately, the Commission has already launched a formal investigation into Samsung's similar approach to patent protection and has warned that other probes may follow.
Microsoft says Motorola is demanding an unreasonable fee for using its patents, amounting to 2.25 percent of the products' total price. For a $1,000 laptop that would mean a royalty of $22.50 for using 50 patents related to a video standard. Microsoft says a group of 29 companies that hold the other 2,300 patents related to this standard charge a total of 2 cents for using them.
"If every firm priced its standard essential patents like Motorola, the cost of the patents would be greater than all the other costs combined in making PCs, tablets, smartphones and other devices," Heiner wrote. "Obviously, this would greatly increase the prices of these devices for consumers."

?It felt good,? Howard said during a press conference on Wednesday. ?The swing feels good.?
It was only spring training batting practice, a brief moment in a long season, and yet it was a startling thing to witness. It made for a stark contrast to the last time Howard appeared on a baseball field. That was an unfortunate scene -- Howard crumpled on the ground, clutching his ruptured right Achilles tendon, while the Cardinals celebrated their NLDS win over the stunned Phillies at Citizens Bank Park. As symbolism goes, it?s hard to imagine something uglier and more powerful. Howard was asked whether he?s seen the footage of that moment, or whether it remains too painful to watch.
?It was painful when it happened,? Howard quipped, ?I can tell you that.??????????? ?
Even before the injury, Howard had his detractors -- those who think he?s overvalued and overpaid (his five-year, $125 million extension kicks in this year). Last year, Howard hit .253 with 33 homers, 116 RBIs and an OPS of .835. He?s 32 years old. Albert Pujols is also 32. He hit .299 with 37 homers, 99 RBIs and a .906 OPS a year ago. Prince Fielder, 27, hit .282 with 38 homers, 120 RBIs and a .981 OPS. You can see where this is going.
During the off-season, Ruben Amaro defended Howard and his contract against those who think he?s not nearly as good as Pujols or even Fielder. And on Tuesday Charlie Manuel said he thinks Howard?s ?best years are still ahead of him.?
Maybe Amaro and Manuel are right, or maybe they?re just putting a happy face on a sad situation that has to concern the organization even if no one wants to say so publicly. Whatever you may think of Howard -- whether you believe he?s one of the game?s best sluggers or you?re an intractable WAR advocate who yammers incessantly about him being overrated -- it?s hard to deny what he means to the Phillies and their lineup.
Last year, he accounted for 16.3 percent of the team?s RBIs and 21.5 percent of its home runs. That?s a significant chunk of the offense. And if you?re among the naysayers, you should also consider that 19 of his 34 homers (which includes the playoffs) in 2011 either tied a game or helped give the Phillies the lead. It?s hard to imagine any combination of Thome, Ty Wigginton, John Mayberry and Jimmy Unnamed Fill-in Player replacing that kind of production while Howard is out of the lineup.
Even more worrisome: What if Howard isn?t himself when he finally returns? What then? The Phillies, as everyone knows, weren?t the same unstoppable hitting machine in 2011 that they were in years past -- and that was when Howard was healthy. You have to wonder what the offense might look like if Howard can?t put up the numbers the Phils have always counted on him to produce. (He?s had six straight seasons with at least 30 home runs and 100 RBIs.)
Howard said he isn?t concerned about his hitting and added that he feels fine swinging a bat. That?s an encouraging thing to hear. But he also said that healing his Achilles has been a complicated process, and it isn?t over yet. That is decidedly less encouraging.
?It?s kind of like learning how to run all over again,? Howard said. ?I?ve been walking with a limp for the most part after being in the boot for two months. You kind of have to get rid of that gimp, that little limp that you have going. Right now, strength-wise it?s starting to come. But I?m taking it slow.?
His words -- that he?s getting stronger, but that he has to re-teach himself how to run -- said so much. In addition to the oral report about his health, Howard provided a strong visual clue concerning the status of his rehabilitation. At the press conference, Howard wore a light gray shirt. The doctors said they would keep a close watch on the emperor's conditions until he is deemed fit to leave hospital.
"The operation's success will be measured by whether the emperor can regain the normal lifestyle he had wished for. We are looking forward to that day, but until then, we'll use the word success sparingly," said Juntendo University's Atsushi Amano, another surgeon who operated on the emperor.
Akihito checked into hospital on Friday and is expected to remain there for about two weeks for rehabilitation, they said.
Akihito had surgery for prostate cancer in 2003 and suffered stress-related health issues in late 2008. The following year, the royal agency said he would cut back on official duties such as speeches and meeting foreign dignitaries.
The latest surgery could prompt the royal agency to further limit the emperor's activities.
"Considering the fact that the emperor will not be getting any younger, we will continue to review the amount of duties he performs," said Ichiro Kanazawa, the Imperial Household Agency's medical supervisor.
Save for rare occasions, the Japanese imperial family is spared the intense public attention or media scrutiny that Britain's royals get.

UFC Undisputed 3 Video Game Review : UFC Undisputed three is a blended martial arts online game featuring Ultimate Preventing Championship properties and fighters developed by Yuke's and published by THQ. World stock markets rise as Japan exporters surge
BANGKOK (AP) - World stock markets rose Wednesday after Greece indicated a willingness to commit to spending cuts to secure its bailout and moves by Japan's central bank to support the economy lifted its powerhouse export sector.
Benchmark oil rose above $101 per barrel while the dollar fell against the euro and was steady against the yen.
European shares rose in early trading. Britain's FTSE 100 gained 0.2 percent to 5,912.27 and Germany's DAX added 1.1 percent to 6,799.65. France's CAC-40 gained 0.7 percent to 3,399.91.
Wall Street was set to head higher, with Dow Jones industrial futures rising 0.4 percent to 23,893 and S&P 500 futures adding 0.4 percent to 1,353.30.
The gains followed strong advances in Asia. The Nikkei 225 index in Tokyo soared 2.3 percent to close at 9,260.34, its highest close since Aug. 5. The surge comes a day after the Bank of Japan announced a further loosening of monetary policy through increased purchases of government bonds, raising hopes the yen's strength could abate.
South Korea's Kospi gained 1.1 percent to 2,025.32. Hong Kong's Hang Seng jumped 2.1 percent to 21,365.23, its highest finish since Aug. 4. Australia's S&P/ASX 200 index closed up 0.3 percent at 4,253.40. Benchmarks in Singapore, Taiwan and Malaysia also rose while Indonesia and New Zealand fell.
Markets found hope in reports quoting Greek government officials as saying party leaders would promise by Wednesday to implement deep spending cuts and other reforms.
That came after talks to extricate Greece from a two-year debt crisis appeared to unravel late Tuesday after European finance chiefs canceled a meeting to discuss a second international bailout for the country.
The meeting was called off after Athens failed to deliver on several demands made by its partners in the euro currency union. Greece needs a $171 billion (euro130 billion) bailout by March 20 to avoid a default that could rattle the world financial system.
The country has already passed some of the deep spending cuts its lenders were demanding but hasn't really satisfied anyone. Greeks have rioted, saying the cuts are too harsh, and Greece's neighbors have expressed concern that the cuts are not enough.
Greece also said its economy shrank drastically at the end of last year, and Europe is expected to report Wednesday that the economies of the 17 countries that use the euro shrank 0.4 percent after growing 0.1 percent the quarter before.
Late Monday, Moody's also downgraded its debt ratings on six European countries, including Italy, Portugal and Spain. Moody's also said it might cut France, Austria and the U.K. as well.
Japanese exporters rose sharply as the persistently strong yen showing signs of abating on the heels of the central bank's surprise announcement Tuesday. Mazda Motor Corp. jumped 8.3 percent and Toyota Motor Corp. surged 4.7 percent. Sony Corp. was 5.7 percent higher. Nintendo Co. added 4.5 percent.
But shares of Japanese computer chip maker Elpida Memory Inc. plunged 14.4 percent, after the company said Tuesday that talks were not going well with other companies on investments, loans and partnerships to improve its dire financial conditions.
South Korean technology shares jumped. Samsung Electronics Co. added 5.1 percent while Hynix Semiconductor Inc. gained 5.3 percent.
Mainland Chinese shares advanced with the benchmark Shanghai Composite Index climbing 0.9 percent to 2,366.70, its highest close this year. The Shenzhen Composite Index gained 1.5 percent to 925.99.
A pledge by China's central bank governor, Zhou Xiaochuan, for China to continue investing in crisis-stricken Europe helped fuel the rally, said Peng Yunliang, an analyst based in Shanghai.
"Trading volume was about 30 percent more than yesterday and investors expect the authorities to boost liquidity," he added.
Shenzhen-based Dongfang Electronics Co. and Gohigh Data Networks Technology Co. both hit the daily upside limit of 10 percent on expectations that authorities will promote further development of the Internet as a national strategy.
Benchmark oil for March delivery was up 74 cents to $101.48 per barrel on the New York Mercantile Exchange. The contract fell 17 cents to finish at $100.74 per barrel on the Nymex on Tuesday.
In currency trading, the euro strengthened to $1.3158 from $1.3095 late Tuesday in New York. The dollar slipped slightly to 78.43 yen from 78.45 yen.

EU seen approving Google's Motorola deal: sources (Reuters)
BRUSSELS (Reuters) ? Google Inc (GOOG.O) is expected to win approval next week from European regulators, as well as from U.S. antitrust authorities, for its planned $12.5 billion purchase of Motorola Mobility (MMI.N), according to people familiar with the matter.
Web search leader Google, which is buying the handset maker to boost its patent portfolio, is seen winning unconditional EU clearance for the deal, two people with knowledge of the matter said on Friday.
The deal was announced last August.
The U.S. Justice Department is also expected to approve the acquisition next week, two separate sources who are close to the antitrust review told Reuters on Thursday.
After U.S. and European approval, the companies would still need approval from China. Regulators in China have until March 20 to decide whether to approve the deal or start a third phase of review, according to source close to the situation. It was not immediately possible to contact China's Ministry of Commerce for comment on this story.
Regulators in Israel and Taiwan also have not yet signed off on the deal.
The European Commission is scheduled to decide by Monday whether to clear the deal or embark on a more in-depth review.
"The Commission is expected to clear this deal without requiring any concessions from Google," one of the sources said.
The European regulator is expected to say the deal will not stifle competition, two of the sources said.
One source said it was possible the Commission could decide on Monday to open an in-depth investigation into the deal instead of clearing it, but that this was highly unlikely.
While the U.S. Justice Department and the Commission are coordinating their actions, it is possible their decisions may not come on the same day, another source familiar with the matter said.
Representatives for Motorola and Google declined comment.
Google announced in August that it would buy Motorola for its 17,000 patents and its 7,500 pending patent applications as it looks to compete better with rivals such as Apple Inc (AAPL.O) and defend itself and manufacturers using its Android phone software in patent litigation cases.
The legal patent war among technology and smartphone makers has prompted the Commission to open an investigation into legal tactics used by Samsung Electronics (005930.KS) against Apple and whether these breach EU antitrust rules.
Earlier this week, Google pledged to license Motorola patents on fair and reasonable terms if the deal succeeds.
In letters to standard-setting organizations around the world, it promised to keep a cap on the fees it charges for licensing its technology. That cap would be 2.25 percent of the net selling price for each phone. Google also outlined the conditions under which it would sue companies for patent infringement.
Microsoft Corp (MSFT.O) also promised on the same day not to seek injunctions to ban products based on standard-essential patents.
In 2010, U.S. business software maker Oracle Corp (ORCL.O) won unconditional EU approval for its $7 billion takeover of Sun Microsystems, a month after a public pledge to rivals and users aimed at easing regulatory concerns.
Google shares were down 6 percent at $605.45 in afternoon trade on Nasdaq, while Motorola Mobility shares were up 6 cents at $39.41 on the New York Stock Exchange.

I will ask a subjective question: Can one measure a great teacher?
More recently, it has been nearly impossible to turn on the tv set, listen to the radio, or peak at a newspaper without viewing a story regarding the state of special education today. It is difficult to not take it personally when people constantly seem to have a point of view on what educators must ultimately do to ?evolve.?
In the past few weeks, I have worked late on many occasions, particularly on Fridays. I derive pleasure the quiet within the lonely walls of the building as I enjoy music in my classroom. I work much more efficiently knowing that I am able make copies without having to wait for anyone. In addition, I can jet through the halls from printer to printer without traffic congestion from other people. It was during this private time that I began to think about the following question. What qualities does the ?perfect? special education educator have?
Do creative concepts create a better teacher? Or is it the time dedicated to the craft of teaching?
Or do years of experience form a nice teacher?
It all comes down to organization? Perhaps good teachers manage their time so well that they really can get everything done throughout each school day.
When I asked the question to one of my students, the answer was simple ?Perfect teachers care about us.?
And thus I concluded that the concept of the ?perfect? teacher is maybe very different for each and every one of us. The perfect teacher is one who evokes positive emotions from themself and onto those that they are teaching. The perfect teacher should instill confidence, happiness, and security while being nurturing, patient and willing to fight for the benefit of their students. To me, that is the best way I know of to measure a great teacher.

BEIRUT (AP) ? Russia and China vetoed a U.N. Security Council resolution aimed at ending Syria's bloodshed, despite international outrage Saturday over a devastating bombardment of the city of Homs by President Bashar Assad's forces. Activists said more than 200 were killed in the bloodiest episode of the nearly 11-month uprising.
The veto and the show of support by Russia raised concerns that Assad's regime could now unleash even greater violence to crush the revolt against his rule, assured that his ally would prevent international action while continuing its weapons sales to Damascus.
It could also push an opposition despairing of other options further into an armed response, fueling a cycle of violence that threatens to tear apart the Arab nation. A movement that began with peaceful protests in March has already turned increasingly to the weapons of rebel soldiers to defend itself against Assad's crackdown.
The overnight onslaught on restive neighborhoods in Homs, Syria's third largest city, signaled a willingness by Assad's regime to bring a new level of violence to stamp out its opponents. Its timing, hours before a planned vote on the U.N. resolution, suggested Assad was confident of his ally Russia's protection on the world stage.
Activists' reports of the death toll from the assault could not be independently confirmed.
The Syrian government denied any bombardment took place at all, saying the reports were opposition propaganda aimed at pressuring the United Nations. It said bodies of the dead that appeared in activists' online videos were those of people who had been kidnapped previously by "terrorists."
Residents of Homs on Saturday described a night of relentless bombardment by mortars and rockets that lasted until dawn, sending them fleeing to lower floors and basements. When daylight came, dozens of buildings were left punctured by shells, facades collapsed, and some streets were stained with blood.
Thousands gathered for a funeral ceremony for some of the victims in the worst hit neighborhood, Khaldiyeh, where more than 60 coffins and bodies in white shrouds were lined up in a park, according to footage of the scene.
"A few more nights like this one and Homs will be erased from the map," Ammar, a resident, said, speaking on condition that only his first name be used for fear he and his family could be targeted. "We are being massacred."
The bloodshed added new urgency to negotiations over the resolution, as Western and Arab nations amended drafts to overcome Russia's opposition.
"The Assad regime must come to an end," President Barack Obama said in a statement Saturday before the vote, calling on the Security Council to "stand against the Assad regime's relentless brutality."
Early drafts demanded Assad carry out an Arab League peace plan by which he would hand over his powers to his vice president and allow formation of a unity government. That was amended to an expression of support of the plan without detailing its provisions. Also added were calls for "all armed groups" ? a reference to army defectors ? to stop violence.
But Russia demanded further changes, saying the draft did not make enough demands on the armed opposition in Syria and that calls for Assad to step aside could wreck chances for a negotiated solution to the country's upheaval.
In the end, the resolution's proponents pushed ahead with a vote, challenging Moscow to veto or back down.
After the double veto, U.S. Ambassador Susan Rice said her country was "disgusted" by the vote.
French Ambassador Gerard Araud said Russia and China had "made themselves complicit in a policy of repression carried out by the Assad regime."
Russian Ambassador Vitaly Churkin accused fellow council members of being inflexible, saying proposed Russian amendments had been ignored. Chinese Ambassador Li Baodong said his country joined Russia in voting against the resolution for the same reason.
Moroccan Ambassador Mohammed Loulichki, a key sponsor of the resolution, said he still hoped that consensus could be reached later on a Security Council measure to stop the violence.
Syria has been a key Russian ally since Soviet times, and Moscow remains a key arms supplier to Damascus. Russia has opposed any U.N. call that could be interpreted as advocating military intervention or regime change. Russia and China also used their veto powers in October to block an attempt to condemn the violence in Syria.
In a glimpse into his thinking, a pro-Syrian Lebanese politician who met with the Syrian leader last week told a Lebanese newspaper that Assad was "confident in the Russian position."
Wiam Wahhab said Assad told him that the time had come to decisively put an end to the uprising. "The price of chaos is worse than the price of decisiveness," he quoted Assad as saying.
George A. Lopez, a professor at the University of Notre Dame's Kroc Institute for International Peace Studies, said Assad will likely see the veto as a green light to step up a crackdown that has killed well over 5,400 people since March, according to a U.N. estimate.
"I expect the regime will now unleash all the guns ? literally ? as the global condemnation has not occurred," he said.
With the resolution's defeat ? and the apparent death knell of the Arab League peace plan ? Burhan Ghalioun, head of the Syrian National Council, the main opposition umbrella, called for "friendly nations," particularly Arabs, to form a coalition to "support the Syrian people in all ways that the liberation of Syria requires."
That could include, "if necessary, support for the Free Syrian Army to protect the Syrian people," he told Al-Arabiya TV.
The Free Syrian Army is a force made up of army defectors who initially mainly acted as a defense for protesters. But in recent months, it has stepped up offensive attacks on regime forces and has grown increasingly bold in attempts to overtly control opposition-dominated cities, towns and neighborhoods.
It is believed to number in the thousands of fighters, though its true size is unknown, and it is heavily outgunned by regime forces.
Last week, regime troops carried out a major offensive that crushed FSA fighters who took control of suburbs of Damascus, bringing them to the doorstep of the capital.
There were signs that the bombardment in Homs was in response to moves by rebels.
Residents reported that the fighters set up new checkpoints in several areas, and two Homs activists said defectors attacked a military checkpoint in the Khaldiyeh district Thursday night, capturing 17 soldiers. The activists spoke on condition of anonymity to protect themselves from retaliation.
On Saturday, thousands protested across Syria in solidarity with the beleaguered city. "Homs, your blood will not go in vain," read a banner held by a protester a Damascus suburb.
At least 21 people were killed in violence outside Homs on Saturday, including 12 shot when security forces opened fire on a funeral procession for victims of a shooting in the Damascus suburb of Daraya a day earlier, according to the British-based Syrian Observatory for Human Rights.
Tunisia decided to expel Syria's ambassador and end its recognition of Assad's regime in response to what it called a "bloody massacre" in Homs. Angry Syrians stormed their embassies in Berlin, London, Athens, Cairo and Kuwait, clashing with guards and police and ? in Cairo ? setting fire to part of the embassy. Syrian exiles and supporters in Libya occupied the already-vacated embassy in Tripoli, saying it was now theirs to use.
In Homs, residents of the overwhelmingly Sunni Muslim district of Khaldiyeh checked on relatives after a night spent in hiding and cleaned streets of shattered glass, debris and bloodstains.
Online video by activists during the onslaught showed chaotic scenes in a makeshift clinic in what appeared to be a Khaldiyeh mosque ? a room filled with wounded men with gashes and broken limbs being bandaged, as well as several dead bodies. In another video, fire ravaged a house that had been shelled.
The videos could not be independently verified.
Residents said most shelling came from a military installation west of Khaldiyeh and Alawite-dominated neighborhoods to the east. Syria's Alawite minority, which belongs to an offshoot of Shiite Islam, forms the backbone of Assad's regime and the military leadership.
Homs has been one of the biggest centers of anti-regime protests and has been hit by near daily regime raids. It has also seen bloody bouts of tit-for-tat killings between its Alawite and Sunni communities, a harbinger of what many Syrians fear could happen if the country descends into an outright civil war.
The Syrian Observatory said the death toll in Homs was at least 217, counting victims whose names it had collected. About 140 of the deaths were in Khaldiyeh, it said. The Syrian National Council put the toll at more than 220.
Mohammad, a Khaldiyeh resident who like most in Homs declined to be further identified, said the shelling started shortly before midnight and lasted until early Saturday.
"We were sitting at home and the mortars just started slamming into buildings around us," he said by telephone. "It's a catastrophe, no other way to describe it."
